Ceremony Guidelines

  • Ceremonies are by appointment only.
  • The individual not in custody is responsible for obtaining the marriage license, securing a qualified licensed officiant, and paying all associated fees.
  • Attendance is limited to:
     - The individual not in custody
     - The licensed officiant
  • No witnesses or minors are permitted.
  • Rings and physical contact are not permitted.
  • Ceremonies may be conducted through the visitation glass using the onsite telephone.
  • Following the ceremony, the incarcerated individual will be subject to a standard unclothed search.
  • Applicants with active warrants, protective orders, or no-contact orders are not eligible to participate.

Additional Information

All costs associated with the marriage, including the marriage license, officiant, and any related fees, are the responsibility of the individual not in custody and the incarcerated individual.

Marriage ceremonies are subject to facility operations, security needs, and available scheduling.

How to Request an Inmate Marriage

Step 1: Complete the Absentee Marriage License Application

The individual not in custody must obtain an Absentee Marriage License Application from the Texas County Clerk’s Office. Special Circumstances instructions for affidavit of Absent Applicant can be found here.

Step 2: Complete the TCSO External Marriage Request

The individual not in custody will complete PART A only of the TCSO External Marriage Request.

The incarcerated individual will complete PART B of the request form in the presence of a correctional officer.

Step 3: Submit both Forms for Review

The individual not in custody will submit both the Absentee Marriage License Application AND the TCSO External Marriage Request together. The request will undergo a security review and be routed through the facility’s chain of command for approval.

You must include the incarcerated individual’s full name and booking number.

If approved, the incarcerated individual will be notified. The request will remain on file pending completion of the ceremony.

  • The incarcerated individual will sign the application before a correctional officer and notary.
  • Any required notary fees will be paid from the incarcerated individual’s trust fund account.
  • The completed application will be mailed back to the individual not in custody.

If denied, the decision will be reviewed to ensure it is based on legitimate safety and security concerns.
The incarcerated individual will be notified of the denial.

Step 4: Approval Notification

The Facility Captain’s Office will contact the individual not in custody once the marriage request has been approved and provide further instructions for the next steps.
